Defra stance ‘unchanged’ on 2024 EPR date amid growing doubts

Defra has said its position “has not changed” on the 2024 date for extended producer responsibility (EPR) to be rolled out, despite widespread rumours of a delay.

EPR for packaging is due to begin next year, with producers gathering data ready for payments to be made.

However, there has been growing doubts in recent weeks over the timelines with many seemingly resigned to the fact it will be delayed. Producers have been pushing Defra to delay the scheme until local authorities “are prepared” for the additional material, while the government says EPR payments will help fund consistent collections.

Speaking at the inaugural letsrecycle.com National Conference & Dinner in London last month Karen Betts said while industry supports the legislation it is not “fit for purpose” as it stands (see letsrecycle.com story).

There has also been reports in the national media that the Prime Minister himself also met ministers about shelving EPR to prevent additional consumer costs during the cost-of-living crisis.

‘Unchanged’

Despite this, Defra said its position on EPR remains “unchanged”.

A spokesperson said: “Work is ongoing to deliver our Extended Producer Responsibility scheme and we’re continuing to engage closely with manufacturers, retailers, and packaging companies on the design of the scheme.

“We will continue to work with industry as we finalise plans to ensure that the schemes will deliver our environmental goals.”

The department added: “We constantly keep our plans under review. All four UK administrations are taking a joint approach to introducing this scheme and it will operate UK-wide. The revenue generated will support better local council services and mean that all households can recycle the same packaging materials.”

“We are committed to continuing to work closely with industry on the final design of the scheme and as delivery plans are finalised.”

2024

The latest statement from Defra however made no reference to the 2024 date, whereas a statement in June did.

In June, the department said: “The plans for EPR, which will be phased in from 2024, play a key part in delivering those goals. All four nations are taking a joint approach to introducing this scheme and it will operate UK-wide.”

Defra insisted however that its position “has not changed” on the 2024 date.

In order for EPR to be delayed, the government would have to publish a statutory instrument to alter previous legislation which has schedule EPR in for 2024. There are some suggestions that any move to delay EPR will be above the department and in the hands of senior Whitehall ministers.

A delay could also take the form of a delay to payments being made, which would allow the legislation to be passed but payments to be made at a new date.

Complexities

To ensure the system is ready, there is still a lot to be done and while Defra is still sticking to 2024 the precise timetable could still be delayed because of the complexities of the new system with a huge amount to do in terms of funding arrangements and collection methodology.

There is also the issue of the 2024 general election, which could add another layer of delays if the new system doesn’t move forward at a quick pace.
