HSE to prosecute Coventry council over RCV death

The Health and Safety Executive has confirmed that it will be taking Coventry city council to court concerning an 11-year-old girl killed by a refuse vehicle last year.

A spokesman for the HSE said last night that the prosecution is being brought under health and safety at work regulations, but no court date has been decided as yet.

The incident in question, which happened in the Stoke area of the city at 7.45am on the morning of Tuesday 4 April (see letsrecycle.com story), saw a coroner record a verdict of accidental death at the end of last year.

Following an initial investigation into the incident, the HSE issued an improvement notice on the council to ensure that health and safety measures were fully implemented in all its general procedures. This action was separate from the full investigation into the incident, which concluded last week (February 21).

Prosecution
Confirming the prosecution yesterday, a HSE spokesman said: “The HSE will be bringing a prosecution against Coventry city council under section 3 of the H7S at Work Act 1974, and Regulation 3 of the Management of Health and Safety at Work Regulations 1999.”

“Coventry city council will be informed when a court date is set,” he added.
