The fresh attempt comes a just a month after a judge threw out their last call for a judicial review of the government's approval of the 200m energy-from-waste plant (see letsrecycle.com story).

Bexley is objecting to the scale of the incinerator – it is being designed to process an average of 585,000 tonnes of waste a year – and also the fact that the plant is to deal with waste from central London.
The Mayor believes that London's waste should not be recycled or composted, with residual waste treated by new technology plants, rather than sent to incinerators.
After 16 years in the planning process, preparations for building the plant at the site at Norman Road on the south bank of the River Thames, are already underway by waste firm Cory Environmental.
The plant is to be used mainly to process waste from the Western Riverside Waste Authority, which is responsible for disposing of waste arising in Kensington & Chelsea, Lambeth, Hammersmith & Fulham and Wandsworth.
“Frustrating”
The leader of Bexley council, Cllr Ian Clement, said it had been “very frustrating” that the judge had thrown out the objectors' request for a judicial review in January.
Commenting prior to today's hearing, he said: “The effects of the Government’s decision upon the Borough are so significant that it must be right that such arguments are fully aired before a final ruling is made. I was therefore delighted to learn that the Oral Hearing for the Application to bring a Judicial Review of the Secretary of State’s decision will be heard on 22 February.

“I believe that building an incinerator at Belvedere will be bad for Bexley, bad for London and bad for the environment,” Cllr Clement added.
