The guidance has been produced by the Environment Agency and clarifies existing criteria for classifying wastes as hazardous or non-hazardous and provides standards, techniques and tests for determining the relevant characteristics of hazardous wastes.
The guidance also identifies a set of protocols to allow for technical and regulatory judgements to be made on how hazardous a batch of waste is.
Produced following an updated and extended versions of the European Waste Catalogue (94/3/EC) and the Hazardous Waste List (94/904/EC) following a periodic review at the European level.
The new list defines hazardous wastes as is required by the Hazardous Waste Directive, but also has knock on effects on the definition of hazardous wastes within regulations such as: Landfills (England and Wales) Regulations 2002; the Pollution Prevention and Control (England and Wales) Regulations 2000; the Hazardous Waste Incineration Directive and other forthcoming legislation which requires account to be taken of hazardous waste, for example regarding ELV and WEEE Directives.
When out, the final guidance will be used as a point of reference for legislation which makes reference to hazardous waste and its management, and to give guidance on the assessment of wastes to all those involved in the production, management and control of hazardous waste in the UK.
