The notice was served against the local authority in the West Midlands on the basis that it: “has not organised its waste transfer depot at Blowers Green Road in such a way as to allow pedestrians and vehicles to circulate in a safe manner”.
The notice was served on 31 March, with the initial compliance date set for 23 May. This was however moved to 1 August upon revision, the reason for which has not been specified.
Three breaches
The improvement notice, published recently on the regulator’s website, cites activity at the waste depot as collection of hazardous waste. The HSE then lists three breaches as involved in this improvement notice, namely a breach of Health and Safety At Work Act 1974 / 2 / 1, Health and Safety At Work Act 1974 / 3 / 1 and Workplace (Health, Safety and Welfare) Regulations / 4 / 1.
Action
Councillor Damian Corfield, Dudley’s cabinet member for highways and environmental services, told letsrecycle.com: “We are taking action to address concerns raised and are working to put measures in place to ensure compliance.”
